Lo que suceda en las siguientes horas depende del nivel de preparaci\u00f3n documental previa de la operaci\u00f3n, no de lo que se improvise ese d\u00eda.<\/p>\n<p>&nbsp;<\/p>\n<h2><b>Marco legal y tipos de visita<\/b><\/h2>\n<p>Conforme al art\u00edculo 540 de la Ley Federal del Trabajo y al Reglamento General de Inspecci\u00f3n del Trabajo y Aplicaci\u00f3n de Sanciones, cuya reforma se public\u00f3 en el DOF el 23 de agosto de 2022, las autoridades laborales federales y estatales ejercen la vigilancia bajo tres modalidades.<\/p>\n<ul>\n<li aria-level=\"1\"><b>Ordinarias: <\/b>programadas conforme a los programas anuales de la autoridad, seg\u00fan la actividad y el historial del centro de trabajo.<\/li>\n<li aria-level=\"1\"><b>Extraordinarias: <\/b>derivadas de denuncias, accidentes graves o presuntas violaciones. Pueden practicarse en cualquier momento.<\/li>\n<li aria-level=\"1\"><b>Orientaci\u00f3n y asesor\u00eda: <\/b>visitas preventivas gratuitas que cualquier empresa puede solicitar y que no conllevan procedimiento sancionador. Una herramienta que casi nadie aprovecha.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><b>Documentaci\u00f3n requerida en seguridad e higiene<\/b><\/h2>\n<p>El alcance depende del tipo de inspecci\u00f3n y del giro, pero la lista de comprobaci\u00f3n t\u00edpica en una planta de manufactura incluye:<\/p>\n<ul>\n<li aria-level=\"1\">Programa de Seguridad e Higiene actualizado y firmado (NOM-030-STPS-2009)<\/li>\n<li aria-level=\"1\">Constancias de competencias laborales, formatos DC-3 (NOM-019-STPS-2011)<\/li>\n<li aria-level=\"1\">An\u00e1lisis de riesgos por puesto y por \u00e1rea de trabajo<\/li>\n<li aria-level=\"1\">Registros de entrega de equipo de protecci\u00f3n personal con firma del trabajador (NOM-017-STPS-2024)<\/li>\n<li aria-level=\"1\">Plan de atenci\u00f3n a emergencias, rutas de evacuaci\u00f3n y evidencias de simulacros (NOM-002-STPS-2010)<\/li>\n<li aria-level=\"1\">Actas de la Comisi\u00f3n de Seguridad e Higiene y sus recorridos<\/li>\n<li aria-level=\"1\">Licencias y permisos de operaci\u00f3n vigentes seg\u00fan el giro<\/li>\n<\/ul>\n<p>El detalle que marca la diferencia: no basta con que los documentos existan. Deben estar vigentes, firmados y disponibles en el momento de la visita. Un simulacro sin lista de asistencia documentada, para efectos de la inspecci\u00f3n, no se realiz\u00f3.<\/p>\n<p>&nbsp;<\/p>\n<h2><b>Plazos sancionatorios y multas<\/b><\/h2>\n<p>La reforma de 2022 dej\u00f3 plazos que todo responsable EHS deber\u00eda tener presentes. La empresa cuenta con 5 d\u00edas h\u00e1biles posteriores al cierre del acta para presentar pruebas que desvirt\u00faen las observaciones. Para diversas materias el reglamento fija un plazo gen\u00e9rico de correcci\u00f3n de 5 d\u00edas h\u00e1biles sin pr\u00f3rroga. La autoridad tiene 10 d\u00edas h\u00e1biles para emitir el emplazamiento una vez iniciado el procedimiento sancionador. Y tras la notificaci\u00f3n de una sanci\u00f3n en materia de seguridad, la autoridad regresar\u00e1 dentro de los 60 d\u00edas h\u00e1biles siguientes para verificar que las correcciones se implementaron.<\/p>\n<p>En lo econ\u00f3mico, el art\u00edculo 994 de la LFT contempla multas de 250 a 5,000 UMAs por incumplimiento en seguridad e higiene, por cada infracci\u00f3n detectada. Y en casos de peligro inminente para los trabajadores, la autoridad puede dictar medidas de aplicaci\u00f3n inmediata: restricci\u00f3n de accesos o limitaci\u00f3n de operaciones en las \u00e1reas de riesgo. Para una l\u00ednea de producci\u00f3n, eso significa paro.<\/p>\n<p>&nbsp;<\/p>\n<h2><b>La preparaci\u00f3n real no empieza cuando llega el inspector<\/b><\/h2>\n<p>La diferencia entre una inspecci\u00f3n que fluye y una que escala est\u00e1 en que el equipo pueda responder tres preguntas en minutos. D\u00f3nde est\u00e1 cada documento y qui\u00e9n es responsable de tenerlo al d\u00eda. Qu\u00e9 permisos est\u00e1n vigentes y cu\u00e1les requieren acci\u00f3n hoy.
