Hazardous Waste Management in Mexico: NOM-052 and SEMARNAT Compliance
Any industrial operation in Mexico that generates hazardous waste — and most manufacturing, chemical, pharmaceutical, automotive, and electronics operations do — must comply with NOM-052-SEMARNAT-2005. This standard defines what constitutes hazardous waste, how it must be classified, stored, transported, and disposed of. PROFEPA enforces compliance aggressively, and violations can result in facility shutdown, fines, and criminal liability. Hazardous waste compliance is not a one-time registration. It is a continuous lifecycle from the moment the waste is generated through its final disposal, with documentation requirements at every step. This guide covers the complete process.
What Is Hazardous Waste Under Mexican Law?
Mexico classifies hazardous waste under the CRETIB system: Corrosive, Reactive, Explosive, Toxic, Flammable, and Biological-Infectious. Any waste stream exhibiting one or more of these characteristics is classified as hazardous and falls under the complete regulatory framework. Common examples by industry: solvents and paint waste (automotive, electronics), acids and alkaline solutions (metal finishing, chemical manufacturing), pharmaceutical waste and expired medications, laboratory chemical waste, used oils and lubricants, batteries and electronic waste, medical waste including sharps and biological materials (healthcare), and cleaning chemical product waste.
Classification is not optional or subjective. Generators must characterize their waste streams against the CRETIB criteria, either through laboratory analysis or by reference to the NOM-052 waste listings. In case of doubt, the waste is presumed hazardous until proven otherwise.
Generator Registration
Every facility generating hazardous waste must register with SEMARNAT as a hazardous waste generator. Registration classifies generators into three categories based on volume:
Large generator: more than 10 tons per year. Must submit a hazardous waste management plan, keep detailed records, and report annually through the COA. Small generator: 400 kg to 10 tons per year. Simplified reporting, but subject to all storage, transport, and disposal requirements. Micro-generator: less than 400 kg per year. Reduced administrative requirements, but must ensure proper disposal through authorized channels.
The registration number (NRA — Environmental Registration Number) is required on all manifests and documentation. Operating without registration is a SEMARNAT violation.
Temporary Storage Requirements
Hazardous waste cannot be stored indefinitely. NOM-052 and the General Law for the Prevention and Comprehensive Management of Waste (LGPGIR) establish strict requirements for temporary storage areas:
The storage area must be covered, ventilated, and have impermeable floors with spill containment. Incompatible waste types must be segregated. All containers must be labeled with the CRETIB classification, generator information, and accumulation start date. Safety Data Sheets must be available for all stored waste.
The critical deadline: large generators may store hazardous waste for a maximum of 6 months from the date of generation. Small generators have up to 12 months. Exceeding these deadlines is a violation regardless of whether the waste is stored correctly.
PROFEPA inspections of temporary storage areas are frequent. The most common violations: missing or incorrect labels, incompatible wastes stored together, poorly maintained containment systems, exceeding storage time limits, and missing documentation.
Transport and Manifests
Hazardous waste may only be transported by companies authorized by SEMARNAT and the SCT (Secretariat of Communications and Transport). The generator is responsible for verifying that the carrier has a valid authorization before releasing any waste. Each shipment requires a hazardous waste transport manifest — a multi-copy document that tracks the waste from the generator to the carrier to the final disposal facility. The manifest includes: generator identification and NRA, waste description and CRETIB classification, quantity and container type, carrier information and authorization number, destination facility information and authorization, and signatures at each transfer point.
The generator must keep its copy of the manifest for at least 5 years. If the completed manifest (confirming final disposal) is not returned within the expected timeframe, the generator must investigate and report to SEMARNAT. The waste remains the generator’s legal responsibility until final disposal is confirmed.
Final Disposal and Verification
Hazardous waste must be disposed of at facilities authorized by SEMARNAT. Disposal methods include: incineration (for organic and biological waste), physico-chemical treatment (for acids, solvents, reactive chemicals), confinement in authorized hazardous waste landfills (for stabilized inorganic waste), and recycling or recovery (for materials with economic value such as solvents, metals, or oils).
The generator must verify that the disposal facility is properly authorized and that the disposal method is appropriate for the specific waste type. Using an unauthorized facility or an inappropriate disposal method makes the generator liable for environmental contamination. Proof of disposal — the completed manifest returned by the disposal facility — is the final link in the compliance chain. Without it, the waste lifecycle is incomplete from a regulatory perspective.
Annual Report: The COA
Large generators must include hazardous waste data in their annual Cédula de Operación Anual (COA) report to SEMARNAT. This includes: total waste generated by type and CRETIB classification, storage volumes and durations, transport manifests and destinations, disposal methods and facilities used, and any incident or spill during the reporting period.
The COA is filed annually, and failure to file is a SEMARNAT violation in itself, independent of any waste management issues. Many companies treat the COA as secondary and discover at filing time that their waste tracking records are incomplete.
Common Violations and Consequences
Operating without generator registration. Triggers immediate enforcement action and possible facility shutdown.
Exceeding storage time limits. One of the most common violations. PROFEPA inspectors check accumulation dates on labels. Using unauthorized carriers. The generator is responsible even if the carrier was hired in good faith.
Incomplete or missing manifests. Every gap in the documentation chain is a violation.
Inadequate storage conditions. Missing labels, no containment, incompatible wastes together, SDS not available.
Failure to file the COA. An independent violation that can trigger separate enforcement from waste management issues.
Consequences: PROFEPA may issue fines, require corrective actions with deadlines, seal the temporary storage area, or seal the entire facility. In cases of environmental contamination, criminal liability may apply under the Federal Environmental Liability Law.
From Tracking to Control
Hazardous waste compliance is fundamentally a tracking problem. Each waste stream must be classified, each container labeled, each storage deadline monitored, each carrier verified, each manifest filed, each disposal confirmed, and each data point reported annually.
